For businesses, Doster Law is not an invention promoter as described in 37 C.F.R. § 4.1. However, Doster Law is familiar with startup business issues (because the firm is itself a startup) and the firm has some relationships with corporate counsel for startups, with a regional startup incubator, and with some small-scale manufacturers in the American southeast. The firm is open to calling on those relationships to help you find solutions to your commercialization issues.

Additionally, for both businesses and their potential investors, Doster Law can perform an informal audit of a business’s intangible assets to see if such assets align with that business’s goals and objectives. Such audits are flexible and would focus on identifying and solving issues that often arise in litigation and enforcement proceedings, such as the following:

• regarding trade secrets, the firm can assess whether the business has implemented “reasonable efforts” to maintain the secrecy of trade secrets;
• regarding marks, the firm can review the business’ registrations to see if the actual offering of goods and services on the market aligns with the goods and services identified in the registrations;
• regarding patents, the firm can review the claims and the prosecution history of the patent to see if the business owns what you think it owns; and
• regarding copyrights, the firm can review the business’ registrations to see if all copyrights that the business wants to be able to enforce have been registered with the U.S. copyright office.
